Acceptance of these terms

By accessing or using magarinosbookkeeping.com, you agree to these Terms of Use. If you do not agree, please do not use the site.

These terms apply to your use of the website. They do not replace or modify any written engagement agreement between you and Magariños Bookkeeping, LLC. Where a signed engagement agreement conflicts with these terms, the engagement agreement controls for the services it covers.

The site is informational

The content on this site, including service descriptions, articles, guides, and the Bookkeeping Health Check, is provided for general informational purposes. It is not tax, legal, accounting, audit, or investment advice, and it is not a substitute for advice from a qualified professional who knows your specific situation.

We are not a CPA firm

Lillian Magariños holds an MBA, a BS in Hospitality Management, and Intuit ProAdvisor and QuickBooks Online certifications, and has more than twenty years of corporate finance experience. She is not a Certified Public Accountant, an Enrolled Agent, or an attorney.

What we do and do not provide

We provide: transaction categorization and recordkeeping, bank and credit card reconciliation, cleanup and catch-up of prior periods, QuickBooks Online setup and training, monthly financial reporting, and 1099 preparation support.

We do not provide: audits, reviews, compilations, or any other attest or assurance services; tax return preparation or filing; representation before the IRS or any state tax authority; tax planning or tax advice; legal advice; investment, securities, or insurance advice; payroll tax filing as a reporting agent; or any service requiring a CPA license, EA credential, or bar admission.

No opinion, assurance, or conclusion is expressed on any financial statement or record we prepare or maintain.

Working with your CPA and tax professional

We coordinate directly with your CPA, Enrolled Agent, or tax preparer and provide clean, reconciled records so they can do their work efficiently. We do not replace them.

Before making any tax, legal, or investment decision, consult a qualified professional licensed to advise you in that area. Reports and records we prepare are a starting point for that conversation, not a substitute for it.

Accuracy and reliance on client information

Our work depends on the completeness and accuracy of the documents, statements, and explanations you provide. We do not independently verify the information given to us, and we are not responsible for errors resulting from incomplete, inaccurate, or withheld information.

You remain responsible for the accuracy of your financial records and for reviewing the reports we deliver.

No guarantee of results

Nothing on this site is a promise or guarantee of a particular financial, tax, or business outcome. Every business is different. Descriptions of past work and any testimonials reflect individual experiences and are not a prediction or guarantee that you will achieve similar results.

Notary Public services

Where notary services are offered, a Florida notary public is not an attorney licensed to practice law in the State of Florida and may not give legal advice about immigration or any other legal matter, or accept fees for legal advice.

A notary verifies the identity of signers and witnesses signatures. A notary does not review, approve, or provide an opinion on the content of any document.

Bookkeeping Health Check

The Bookkeeping Health Check is a free self-assessment tool. Your score is generated from the answers you provide and reflects only those answers.

It is not an audit, review, compilation, examination, or any form of attest engagement. It does not verify the accuracy of your records, and no opinion or assurance is expressed or implied. A high score does not mean your books are correct, and a low score does not mean they contain errors. Do not rely on your score as a basis for financial, tax, or business decisions.

Quotes and pricing

Any pricing shown on this site is indicative. Each client receives a customized quote for every service, determined by factors including the number of bank and credit card accounts, monthly transaction volume, the condition of existing records, the software in use, and the scope requested.

A quote is not an offer capable of acceptance until it is issued in writing for your specific engagement, and it remains subject to change if the scope or the condition of the records differs from what was described.

Acceptable use

You agree not to:

• Use the site for any unlawful purpose or in violation of these terms.
• Attempt to gain unauthorized access to the site, its servers, or any connected system.
• Introduce malware, scrape content by automated means, or interfere with the site's operation.
• Submit false information, or submit another person's information without their permission.
• Copy, reproduce, or republish site content for commercial purposes without written permission.

Intellectual property

All content on this site, including text, graphics, logos, the Magariños Bookkeeping name and mark, page layouts, and the Bookkeeping Health Check, is owned by Magariños Bookkeeping, LLC or its licensors and is protected by United States and international intellectual property laws.

You may view, download, and print pages for your own non-commercial reference. All other use requires our prior written consent.

QuickBooks, QuickBooks Online, ProAdvisor, and Intuit are trademarks of Intuit Inc. BNI is a trademark of BNI Global, LLC. These marks are used to identify certifications and memberships held by Magariños Bookkeeping, LLC. No endorsement, affiliation, or sponsorship by those organizations beyond the certification or membership described is claimed or implied.

Third-party links and services

This site links to third-party websites and uses third-party services, including Calendly for scheduling and AWeber for email. We do not control those services and are not responsible for their content, availability, terms, or privacy practices. Your use of them is governed by their own agreements.

Website content and currency

Tax law, accounting standards, and software features change. Content on this site, including articles and guides, reflects our understanding at the time of writing and may become outdated. We do not undertake to update it, and you should not rely on it as current without confirming it.

Disclaimer of warranties

The site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the site will be uninterrupted, timely, secure, or error free, or that its content is accurate, complete, or current. Tax and accounting rules change, and content may become outdated.

Limitation of liability

To the fullest extent permitted by Florida law, Magariños Bookkeeping, LLC and its owner, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or related to your use of this site, whether based in contract, tort, strict liability, or any other theory, even if advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to your use of this site will not exceed one hundred U.S. dollars ($100.00). This limitation does not apply to services provided under a signed engagement agreement, which contains its own liability terms.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless Magariños Bookkeeping, LLC and its owner, employees, and contractors from any claims, losses, liabilities, damages, costs, and expenses, including reasonable attorneys' fees, arising from your use of the site, your violation of these terms, or your violation of any right of a third party.

Governing law and disputes

These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules.

Any dispute arising out of or relating to these terms or your use of the site will be brought exclusively in the state or federal courts located in Orange County, Florida, and you consent to the personal jurisdiction of those courts.

Before filing a claim, you agree to contact us and attempt to resolve the matter informally for at least thirty days.

General provisions

Changes. We may revise these terms at any time. The revised version takes effect when posted, and your continued use of the site constitutes acceptance.

Severability. If any provision is found unenforceable, the remaining provisions stay in effect.

No waiver. Our failure to enforce a provision is not a waiver of it.

Entire agreement. These terms, together with our Privacy Policy and Disclaimer, are the entire agreement between you and us regarding the site.
